These Terms & Conditions ("Terms") govern your use of Kinder Change.

By accessing or using the Kinder Change platform, you agree to these Terms.

If you do not agree with these Terms, please do not use Kinder Change.

About Kinder Change

Kinder Change is a celebration platform that allows users to:

  • create celebration events
  • receive private financial contributions
  • share celebration messages
  • optionally spotlight charitable causes
  • optionally allocate part of an event total to spotlight charities when withdrawing
  • request withdrawal of collected funds through Stripe

Kinder Change is designed to provide a gentler, lower-pressure alternative to traditional gifting.

Kinder Change is not a bank, financial institution or registered charity.

Spotlight charities may be featured for awareness on the platform. When a host chooses an optional allocation at withdrawal, that amount is released through Stripe to the charity's connected account.

The Kinder Change platform is operated by Kinder Change Ltd (company number 15591026), registered in England and Wales.

Eligibility

You must be at least 18 years old to:

  • create an account
  • create or manage events
  • receive withdrawals
  • set up payouts through Stripe

By using Kinder Change, you confirm that:

  • you are aged 18 or over
  • the information you provide is accurate
  • you have the authority to create or manage any event you publish

Kinder Change accounts and withdrawals are managed by adults aged 18+.

User Accounts

Users are responsible for:

  • maintaining the confidentiality of their login details
  • all activity carried out under their account
  • keeping their account information up to date

Kinder Change reserves the right to suspend or terminate accounts where:

  • these Terms are breached
  • fraudulent or abusive activity is suspected
  • platform misuse occurs
  • content is inappropriate, unlawful or harmful

Events and Contributions

Contribution privacy

Contribution amounts are kept private from public event visitors.

Messages left by contributors may be publicly visible to anyone with access to the event link.

No obligation to contribute

Participation through Kinder Change is intended to remain optional and pressure-free.

Users should not use the platform to harass, pressure or coerce others into contributing.

Contributions are voluntary

All contributions made through Kinder Change are voluntary.

Contributors are responsible for ensuring they are comfortable with any contribution before submitting payment.

Payments and Withdrawals

Payments

Payments are securely processed through Stripe.

Kinder Change does not store full payment card details in our own systems.

Contributions are collected using Stripe's payment infrastructure. Kinder Change facilitates the collection and release of funds for celebration hosts — we do not hold funds in a Kinder Change bank account.

Platform fees

Contributions are charged in full at the point of payment.

Applicable platform and payment processing fees are deducted when funds are released through withdrawal.

Any fees will be shown clearly before withdrawal is completed.

Withdrawals may only be requested by the authorised event owner.

When withdrawal is confirmed, Kinder Change facilitates the release of funds to the host's connected payout account and any optional spotlight charity allocation through Stripe. Timing for funds to reach a bank account may depend on Stripe's processing schedule.

Kinder Change reserves the right to delay, review or restrict withdrawals where:

  • fraud is suspected
  • disputes arise
  • legal obligations require review
  • platform abuse is identified

Refunds and Disputes

Because contributions are voluntary and processed immediately, refunds are not guaranteed.

If a contributor believes a payment was made in error, they should contact:

Refund requests will be reviewed on a case-by-case basis.

Stripe's payment and dispute procedures may also apply.

Charity Spotlight Features

Kinder Change may allow users to nominate charitable causes for optional spotlight features.

Submitting a charity nomination does not guarantee that a charity will be featured.

Where users explicitly consent, selected nomination quotes, first names and broad locations may be displayed publicly.

Kinder Change does not guarantee:

  • the accuracy of third-party charity information
  • ongoing availability of featured charities
  • endorsement of any organisation beyond the spotlight feature itself

Kinder Change does not act as a registered charity or charitable trustee.

Acceptable Use

Users must not:

  • use Kinder Change for unlawful purposes
  • upload abusive, hateful or harmful content
  • impersonate another person
  • attempt to access unauthorised data or accounts
  • interfere with platform security
  • use the platform for spam or fraudulent activity
  • upload malicious code or automated abuse tools

Kinder Change may remove content or suspend access where necessary to protect users or the platform.

User Content

Users retain ownership of the content they submit to Kinder Change.

By posting content, users grant Kinder Change a limited licence to:

  • display
  • host
  • store
  • process
  • moderate

that content for the purpose of operating the platform.

Users remain responsible for ensuring they have the right to share any uploaded images, messages or content.

Intellectual Property

Kinder Change branding, platform design, logos, text and original content are protected by intellectual property laws.

Users may not copy, reproduce or commercially exploit Kinder Change materials without permission.

Availability of the Platform

We aim to keep Kinder Change available and functioning smoothly, but we cannot guarantee uninterrupted access.

Kinder Change may occasionally experience:

  • maintenance periods
  • technical interruptions
  • third-party outages
  • payment provider issues

We reserve the right to modify, pause or discontinue features where necessary.

Limitation of Liability

To the fullest extent permitted by law, Kinder Change shall not be liable for:

  • indirect or consequential losses
  • emotional distress arising from user interactions
  • disputes between users
  • failed or delayed payments caused by third parties
  • loss of data beyond reasonable control
  • unauthorised access resulting from user negligence

Nothing in these Terms excludes liability where exclusion would be unlawful.

Privacy

Use of Kinder Change is also governed by our Privacy Policy.

Please review the Privacy Policy carefully to understand how personal information is handled.

Changes to These Terms

We may update these Terms from time to time.

Where significant changes are made, we may notify users through the platform or by email.

Continued use of Kinder Change after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes arising in connection with Kinder Change shall be subject to the jurisdiction of the courts of England and Wales.
